Handling applicant data
We offer you the opportunity to apply to us (e.g. by e-mail, post or via the online application form). In the following, we inform you about the scope, purpose and use of your personal data collected as part of the application process. We assure you that your data will be collected, processed and used in accordance with applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.
Only those of our employees who are entrusted with the preparation and implementation of the application process or, in the case of an applicant pool, with the support of the pool and the applicants have access to your data. This includes employees from the HR department and the specialist departments in which vacancies are to be filled.
Scope and purpose of data collection
If you send us an application, we will process your associated personal data (e.g. contact and communication data, application documents, notes taken during interviews, etc.) insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b GDPR (general contract initiation) and - if you have given your consent - Art. 6 para. 1 lit. a GDPR. Consent can be revoked at any time. Your personal data will only be passed on within our company to persons who are involved in processing your application. If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of § 26 BDSG and Art. 6 para. 1 lit. b GDPR for the purpose of implementing the employment relationship.
For the processing of applicant data, we use the services of personnel administration and applicant management software from Personio SE & Co. KG, Seidlstraße 3, 80335 Munich, Germany (hereinafter referred to as "Personio"). The data transmitted as part of your application will be transmitted in encrypted form and stored and processed in a database operated by Personio. Further information on data protection at Personio can be found at: https://www.personio.de/ueber-uns/datenschutz/. Personio processes your personal data on our behalf on the basis of order processing contracts in accordance with Art. 28 GDPR.
Data retention period
If we are unable to make you a job offer, you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6 para. 1 lit. f GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. The retention serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g. due to an impending or pending legal dispute), the data will only be deleted when the purpose for further storage no longer applies. Longer storage may also take place if you have given your consent (Art. 6 para. 1 lit. a GDPR) or if statutory retention obligations prevent deletion.
Inclusion in the applicant pool
If we do not make you a job offer, you may have the opportunity to be included in our applicant pool. If you are accepted, all documents and information from your application will be transferred to the applicant pool in order to contact you in the event of suitable vacancies. Inclusion in the applicant pool takes place exclusively on the basis of your express consent (Art. 6 para. 1 lit. a GDPR). Giving consent is voluntary and is not related to the current application process. The data subject can withdraw their consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, provided there are no legal grounds for retention. The data from the applicant pool will be irrevocably deleted no later than two years after consent has been granted.
Necessity of providing data
In order to be able to decide whether we wish to establish an employment relationship with you or to be able to support you in an applicant pool, we require all or some of the above-mentioned personal data, depending on the position advertised. Without this data, we cannot carry out the application process or include you in an applicant pool. The provision of your applicant data is voluntary.
Automated decision-making in individual cases
As part of the application process, we do not use any purely automated processing for decision-making.
Your rights
Below you will find an overview of your rights as a data subject in connection with data processing as part of the application process in accordance with the applicable data protection regulations. You can assert these rights against us using the contact details provided above.
Right to information
In accordance with Art. 15 GDPR, you have the right to information about your stored personal data, its origin and recipients and the purpose of the data processing at any time. You can also request a copy of your data that is the subject of the agreement.
Right to rectification
In accordance with Art. 16 GDPR, you have the right to rectification or completion of your data stored by us at any time.
Right to erasure / blocking
Under the conditions of Art. 17 GDPR, you have the right to erasure of your data stored by us at any time. This may be the case, for example, if
- the data are no longer required for the purposes for which we collected or otherwise processed them;
- you withdraw your consent, which is the basis for the data processing, and we lack any other legal basis for the processing;
- you object to the processing of your data and there are no overriding legitimate grounds for the processing;
- we have processed the data unlawfully;
This does not apply if the processing is necessary,
- to fulfill a legal obligation that requires us to process your data, in particular with regard to statutory retention periods;
- to assert, exercise or defend legal claims.
Right to restriction of data processing
Under the conditions of Art. 18 GDPR, you have the right to restrict data processing if
- you dispute the accuracy of your data and cannot correct it yourself;
- the processing is unlawful, but you yourself do not wish it to be erased;
- we as the controller no longer need your data in principle, but you should need it to assert, exercise or defend legal claims; or
- you have lodged an objection to the data processing and it has not yet been established whether our legitimate reasons for further data processing outweigh your reasons for the objection.
Right to data portability
If requested by you, we will provide you with the data that you have provided to us personally in a structured, commonly used and machine-readable format and/or transfer it to another controller (e.g. another web store), insofar as this is technically possible (Art. 20 GDPR).
Right to object to the processing
If data is collected on the basis of Art. 6 para. 1 lit. f GDPR (data processing to safeguard legitimate interests), the data subject has the right to object to the processing at any time for reasons arising from their particular situation. We will then no longer process the personal data unless there are demonstrably compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves the establishment, exercise or defense of legal claims (Art. 21 GDPR). You can submit your objection at info@dataciders.com.
Such an objection affects the permissibility of the processing of your personal data after you have raised it with us.
Right to lodge a complaint with the supervisory authorities
You have the right to complain about our processing of your personal data at any time to the data protection supervisory authority responsible for us if you are of the opinion that this processing violates applicable data protection law.
Right to withdraw consent
If you have given us your consent for specific data processing, you can revoke this at any time with effect for the future.
